Terms of Service

Welcome to MelQart, a competitive intelligence platform for e-commerce operated by MelQart Technologies ("MelQart," "we," "us," or "our"). By accessing or using our website at melqart.me and associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

MelQart provides competitive intelligence tools for e-commerce businesses, including but not limited to: competitor price monitoring, product catalogue tracking, AI-powered analysis and briefings, product matching across competitor catalogues, SEO and advertising analysis, and market signal aggregation. The Service collects and processes publicly available data from competitor websites to deliver actionable insights to our users.

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Maintain only one account per person
• Promptly update your information if it changes

You are responsible for all activity that occurs under your account. Notify us immediately at support@melqart.me if you suspect unauthorized access.

All payment processing for MelQart is handled by Paddle.com Market Limited ("Paddle"), our Merchant of Record. Paddle manages all aspects of payment processing, invoicing, sales tax, and VAT compliance on our behalf.

• Subscriptions are billed on a recurring monthly basis
• Subscriptions auto-renew unless cancelled before the next billing date
• Prices are displayed in USD and may be subject to local taxes as determined by Paddle
• Paddle's terms of service and privacy policy also apply to your payment transactions
• We reserve the right to change pricing with 30 days' notice

The Scout plan is available at no cost with limited features. The free tier is provided "as is" and may be modified or discontinued at any time. Free tier users are subject to the same Terms as paid subscribers. We reserve the right to impose additional limitations on free accounts.

MelQart collects publicly available data from competitor websites, including product listings, prices, availability, and other publicly displayed information. By using the Service, you acknowledge that:

• We monitor only publicly accessible data — we do not access password-protected or private areas
• We do not guarantee the accuracy, completeness, or timeliness of monitored data
• Data is refreshed periodically based on your subscription tier
• Competitor website changes may temporarily affect data availability
• You use the data and any AI-generated insights at your own discretion and risk

You agree not to:

• Resell, redistribute, or sublicense MelQart data or insights to third parties
• Bypass, circumvent, or attempt to exceed rate limits or usage quotas
• Abuse the API or use automated tools to overload our infrastructure
• Use the Service for any illegal purpose or to harm competitors unlawfully
• Reverse engineer, decompile, or disassemble any part of the Service
• Share account credentials or allow unauthorized third-party access
• Interfere with or disrupt the Service or its infrastructure

MelQart and its licensors retain all rights, title, and interest in the Service, including all software, algorithms, designs, and documentation. "MelQart" and our logo are trademarks of MelQart Technologies.

You retain ownership of all data you provide to the Service (your store data, product catalogues, etc.). You grant us a limited license to process your data solely to provide and improve the Service.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

To the maximum extent permitted by applicable law, MelQart and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or relating to your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. The Service is provided "as is" without warranties of any kind, express or implied.

Either party may terminate the subscription at any time. Upon cancellation:

• You retain access to the Service until the end of your current billing period
• Your data will be retained for 30 days following account closure
• After 30 days, all your data will be permanently deleted
• We may terminate your account immediately for violation of these Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email at the address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
